Entitlement to Bildungsurlaub


In principle, every employee in Germany who is working for his company for at least six months has the right to take Bildungsurlaub.

There is no statutory right to Bildungsurlaub in the federal states of Bavaria and Saxony. Please contact your employer directly to clarify whether a Bildungsurlaub can be approved. The following provisions apply to all other federal states:

 

Baden-Württemberg: In Baden-Württemberg, employees are entitled to leave work free of charge and to apply for Bildungsurlaub if the language course covers at least 30 weekly hours of 60 minutes each. There is no single action detection but a carrier recognition. After 12 months of employment, every employee has the right to Bildungsurlaub up to five days a year. Therefore, the application must be submitted to the employer at least eight weeks before the start of the seminar.

Berlin: Every single course date has to be applied again in Berlin. For this reason we ask for a timely registration 10 weeks before the start of the trip. There must be a 30-hour training period of 45 minutes per week. Employees older than 25 years are entitled to 10 days of Bildungsurlaub within two years. For employees up to 25 years, it is 10 days per year. The employment relationship must be at least six months.

Brandenburg:
The application can be placed directly in Brandenburg via the language school abroad, which you would like to go to. This must be done at the latest six weeks before the beginning of the course. There must be a 30-hour training period of 45 minutes per week. Employees over 25 years are entitled to 10 days of Bildungsurlaub within two years. For employees up to 25 years, it is 10 days per year.

Bremen: In Bremen every employee has the right to 10 days of Bildungsurlaub, regardless of his or her age, within two years, but at the earliest six months after his appointment. 30 hours of 45 minutes per week and 8 hours of 45 minutes per day are compulsory.

Hamburg: In Hamburg every employee has the right to 10 days of Bildungsurlaub, regardless of his age, within two years, but at the earliest six months after his appointment. Daily lessons must be taken six hours a day. Requirement 30 week hours à 45 minutes.

Hessen: The state of Hessen does not issue its own acknowledgments, but accepts the decisions of other states. The prerequisite is 30 hours per week of 60 minutes. The scope of the possible Bildungsurlaub days is five days per year and the application can be submitted at the earliest six months after the employment relationship. In Hessen there is the restriction of entitlement to Bildungsurlaub to max. 33% of employees (converted) per year.
Mecklenburg-Vorpommern: In Mecklenburg-Vorpommern, every employee has the right to five days of Bildungsurlaub per year, but at the earliest six months after employment. Daily lessons must be taken six hours a day. The prerequisite is 30 hours per week of 60 minutes. Processing time of application is normally 6-12 weeks.

Niedersachsen: Application to the employer at the latest 4 weeks before the beginning of the course. Language travel, which is recognized as Bildungsurlaub, must have 30 lessons of 60 minutes each. Employees are entitled to five days of Bildungsurlaub per year. An application can be made at the earliest 6 months after employment.

Rhineland-Pfalz: In Rhineland-Pfalz, employees in small companies with fewer than six employees do not have any right to Bildungsurlaub. In all other companies, the application must be submitted at least six weeks before the start of the course. 30 hours of 45 minutes per week and 6 hours of lessons per day. The application can only take place after an employment period of more than six months. Every employee has 10 days Bildungsurlaub in two years. Trainees have five days a year.

Saarland: Requirement 30 week hours à 45 minutes. Saarland recognizes the decisions of other federal states, if the conditions are identical (among others Niedersachsen and Hamburg). The application must be submitted at least six weeks before the start of the course. In companies with up to 50 employees, it is possible to credit vocational training courses, but in companies with up to 100 employees, Bildungsurlaub won’t be granted to more than 30% of the workforce. In Saarland, an employment relationship must last 12 months before an application for Bildungsurlaub can be made. The employee is entitled to six months Bildungsurlaub a year.

Sachsen-Anhalt: Requirement 30 week-hours à 60 minutes. For many locations, Bildungsurlaub notifications are already available, so they can be sent immediately after registration. For others, a processing time of 6-12 weeks. The employee must be employed for six months to apply for an Bildungsurlaub and submit the application no later than six weeks before the start of the course. In companies with up to 5 employees, Bildungsurlaub is not granted. Employees have a total of five days of Bildungsurlaub per year.

Schleswig-Holstein:
Requirement 30 week hours à 60 minutes. For many locations, Bildungsurlaub notifications are already available, so they can be sent immediately after registration. For others, a processing time of 6-12 weeks. At the earliest six months after the start of the employment relationship, you may apply for Bildungsurlaub and should do so no later than six weeks before the start of the course. Five days of Bildungsurlaub are granted to the employee every year.

Thuringia: In Thuringia the language courses have to have 30 week-hours of 45 minutes each. In addition to employees and trainees, people who work in recognized workshops for the disabled, as well as (state) officials and judges, may take a holiday. Employees are entitled to five days of Bildungsurlaub per year, trainees to three. It is only possible to apply for Bildungsurlaub after six months of company membership. The application must be submitted in written form to the employer eight weeks before the start of the seminar. In small businesses up to five employees, there is no claim to Bildungsurlaub.
